We are pleased about your visit to our website and your interest in our company. The protection of your personal data is an important concern for us. Below we inform you pursuant to Art. 12, 13 and 21 of the General Data Protection Regulation (DSGVO/GDPR) about the handling of your personal data when using our website www.linqint.com.

Personal data are individual details about the personal or factual circumstances of an identified or identifiable natural person. This includes information such as the civil name, the address, the telephone number and the date of birth.

II. Purposes and legal bases of the data processing

1. Informational use of the website

You can visit our website without providing any details about your person. If you use our website purely for information purposes without transmitting information about your person to us, we do not process any personal data, with the exception of the data your browser transmits in order to enable you to visit the website as well as information transmitted to us through the cookies used for the statistical analysis of the use of our website.

a. Technical provision of the website

For the purpose of the technical provision of the website it is necessary that we process certain automatically transmitted information from you so that your browser can display our website and you can use the website. This information is recorded automatically each time our website is accessed and stored in the server log files at our web host (Strato AG, www.strato.de).

This information relates to the computer system of the accessing device. The following information is collected in this context:

  • Source IP address, anonymised (e.g. 133.651.753.0)
  • Timestamp (e.g. 08/Jan/20321:100:00:36 +0200)
  • Method (e.g. GET)
  • requested file (e.g. /wp-login.php)
  • protocol used (e.g. HTTP/1.1)
  • Status code (e.g. 301)
  • Size of the content (e.g. 498)
  • browser/system used (e.g. Mozilla/5.0 (Windows NT 6.1; WOW64; rv:40.0) Gecko/20100101 Firefox/40.1)
  • Domain (e.g. www.strato.de)
  • Referer (the previously visited page)

The IP addresses are stored in anonymised form. For this purpose the last three digits are removed, i.e. 127.0.0.1 becomes 127.0.0.*. IPv6 addresses are anonymised as well. The anonymised IP addresses are retained for 60 days. Details of the directory protection user used are anonymised after one day.

Error logs, which record faulty page requests, are deleted after seven days. In addition to the error messages these contain the accessing IP address and, depending on the error, the page requested.

Furthermore we use cookies in order to make our website available to you for use. Cookies are text files that are stored in the internet browser or by the internet browser on your computer system when a website is accessed. A cookie contains a characteristic string of characters that allows the browser to be uniquely identified when the website is accessed again. We use these cookies exclusively in order to make our website available to you with its technical functions. Some functions of our website cannot be offered without the use of cookies. The following information is stored in the cookies and transmitted to us:

  • Session ID

The information we have collected through the above cookies is not used by us to create user profiles or to analyse your surfing behaviour.

We process your personal data for the technical provision of our website on the basis of the following legal bases:

  • for the performance of a contract or in order to take steps prior to entering into a contract pursuant to Art. 6 Abs. 1 Lit. b DSGVO, insofar as you visit our website in order to inform yourself about our services

and

  • to safeguard our legitimate interests pursuant to Art. 6 Abs. 1 Lit. f DSGVO, in order to be able to make the website technically available to you. Our legitimate interest consists in being able to provide you with an appealing, technically functioning and user-friendly website as well as in taking measures to protect our website against cyber risks and to prevent cyber risks for third parties emanating from our website.

b. Statistical analysis of the use of the website and reach increase

For the purpose of the statistical analysis of the use of our website we use Google AdWords, etracker and thereby cookies that allow an analysis of your surfing behaviour. This enables us to improve the quality of our website and its contents. We learn how the website is used and can thus continuously optimise our offering.

The information obtained in the course of the statistical analysis of our website is not merged with your other data recorded within the website.

We process your personal data for the statistical analysis of the use of our website on the basis of the following legal bases:

  • your consent pursuant to Art. 6 Abs. 1 Lit. a) DSGVO.

Google AdWords

We use the online advertising programme “Google AdWords” and, within Google AdWords, conversion tracking. Google conversion tracking is an analysis service of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). If you click on an advertisement placed by Google, a cookie for conversion tracking is stored on your device. These cookies expire after 30 days, contain no personal data and therefore do not serve to identify you personally.

If you visit certain pages of our website and the cookie has not yet expired, Google and we can recognise that you clicked on the advertisement and were forwarded to this page. Every Google AdWords customer receives a different cookie. There is therefore no possibility of cookies being tracked across the websites of AdWords customers.

The information obtained with the help of the conversion cookie serves to create conversion statistics for AdWords customers who have opted for conversion tracking. In this way the customers learn the total number of users who clicked on their advertisement, were forwarded to a page carrying a conversion tracking tag and performed an action there, e.g. contacted us. They do not, however, receive any information by which users can be personally identified.

We use Google Adwords with your consent. You can withdraw this consent by preventing the installation of the cookies through a corresponding setting of your browser software (opt-out option). You will then not be included in the conversion tracking statistics. Google Maps

Google Maps, a service of Google, Inc., is embedded on our website for you.

In order to increase the protection of your data when visiting our website, Google Maps is restricted and embedded in the page merely by means of an HTML link. This ensures that no connection to Google's servers is established when our website is accessed and that your data are not transmitted to Google. Only once you activate the plugins and thereby give your consent to the data transmission does your browser establish a direct connection to Google's servers so that you can plan your route to us. Functionally, the embedding of Google Maps therefore corresponds to a hyperlink, so that neither we nor Google collect any data from you on our website.

c. Social links

Links to services such as Xing, LinkedIn and Google+ are embedded on the website. After clicking the link you are forwarded to the page of the respective provider, i.e. only then is user information transmitted to the respective provider. For information on the handling of your data when using the websites of other providers, please refer to the respective privacy information of those providers.

2. Active use of the website

In addition to the purely informational use of our website, you can also use our website actively in order to contact us or to apply to us. In addition to the processing of your personal data described above for a purely informational use, we then also process further personal data of yours that we need, e.g. in order to handle and answer your enquiry.

a. User enquiries

In order to be able to handle and answer your enquiries to us, e.g. via a contact form or to our email address, we process the personal data you provide in this context. In any case this includes your name and your email address so that we can send you a reply, as well as the other information you send us as part of your message.

We process your personal data for answering user enquiries on the basis of the following legal bases:

to safeguard our legitimate interests pursuant to Art. 6 Abs. 1 lit. f DSGVO; our legitimate interest consists in answering customer enquiries appropriately.

b. Sending an application

We process your personal data in the context of your application, insofar as you provide these to us. The application documents may contain special categories of personal data.

Processing of personal data

As a rule the applicant data comprise the following: first and last name, where applicable your academic degree, date and place of birth, contact details (address, email, telephone and/or mobile number), application documents (cover letter, CV, references), language skills, abilities. In addition we process the data you send us in the course of contacting us by email.

Within the statutory requirements we base our decisions in the application procedure on the personal data you provide. For example, we use your professional qualification for the decision as to whether we include you in the shortlisting procedure, or a personal impression in a job interview in order to decide whether we offer you the position you applied for.

We process your personal data on the basis of the following legal bases:

Processing of special categories of personal data

Pursuant to Art. 9 DSGVO, special categories of personal data are personal data revealing racial and ethnic origin, political opinions, religious (e.g. details of religious affiliation/denomination) or philosophical beliefs or trade union membership, as well as the processing of biometric data for the purpose of unique identification (e.g. photographs), health data (e.g. details of the degree of a severe disability) or data concerning sex life or sexual orientation. If your CV contains special categories of personal data, we do not collect these intentionally. We expressly ask you not to send us such data.

If, as part of your application documents, you voluntarily and contrary to our express request provide us with special categories of personal data pursuant to Art. 9 Abs. 1 DSGVO (e.g. your photograph or details of your religious affiliation/denomination), we store these on the basis of your consent pursuant to Art. 88 Abs. 1 DSGVO i. V. m. § 26 Abs. 3 S. 2 BDSG-neu. This also applies if you provide us with further special personal data in the further course of the application procedure. By voluntarily transmitting these data you consent to the storage of these special personal data within the application process.

As a matter of principle we do not take these special personal data into account in a selection decision, unless it is required on the basis of a legal obligation to take these special personal data into account. For some job advertisements it is possible, for example, that people with disabilities are given preferential treatment in accordance with the applicable laws. In these cases the details are always voluntary and are provided with your express consent, which you have given by voluntarily transmitting these data.

We process your special personal data on the basis of the following legal bases:

IV. Links

Some sections of our web pages contain links to the websites of third-party providers. These websites are subject to their own data protection principles. We are not responsible for their operation, including the handling of data. If you send information to or via such third-party pages, you should review the privacy policies of those pages before providing them with information that can be attributed to your person.

V. Categories of recipients

In the first instance only our employees obtain knowledge of your personal data. In addition, insofar as this is legally permitted or required, we share your personal data with other recipients who provide services for us in connection with our website. In doing so we limit the disclosure of your personal data to what is necessary. In part our service providers receive your personal data as processors and are then strictly bound by our instructions when handling your personal data. In part the recipients act independently with the data we transmit to them.

Below we name the categories of recipients of your personal data:

  • IT service providers for the administration and hosting of our website,
  • where applicable, further categories of recipients.

VI. Third-country transfer

We do not transfer your personal data to countries outside the EU or the EEA or to international organisations.

VII. Duration of storage

1. Informational use of the website

In the case of purely informational use of our website we store your personal data on our servers exclusively for the duration of the visit to our website. After you have left our website your personal data are deleted without undue delay.

Cookies installed by us are as a rule likewise deleted after leaving our website. This does not, however, apply to the cookies of etracker. These remain stored for a period of up to two years. In addition you have the possibility to delete installed cookies yourself at any time.

2. Active use of the website

In the case of active use of our website we initially store your personal data for the duration of answering your enquiry or for the duration of our business relationship. This also includes the initiation of a contract (pre-contractual legal relationship) and the performance of a contract.

In addition we then store your personal data until any legal claims arising from the relationship with you become time-barred, in order to use them as evidence where necessary. The limitation period is as a rule between 12 and 36 months, but can also be up to 30 years.

Once the limitation period has expired we delete your personal data, unless there is a statutory retention obligation, for example under the German Commercial Code (§§ 238, 257 Abs. 4 HGB) or under the German Fiscal Code (§ 147 Abs. 3, 4 AO). These retention obligations can amount to two to ten years.

VIII. Your rights as a data subject

Under the statutory conditions you have the following rights as a data subject, which you can assert against us:

Right of access: You are entitled at any time, within the scope of Art. 15 DSGVO, to request confirmation from us as to whether we process personal data concerning you; if this is the case, you are further entitled, within the scope of Art. 15 DSGVO, to receive information about these personal data as well as certain further information (among others processing purposes, categories of personal data, categories of recipients, envisaged storage period, the origin of the data, the use of automated decision-making and, in the case of a third-country transfer, the appropriate safeguards) and a copy of your data.

Right to rectification: You are entitled to request from us pursuant to Art. 16 DSGVO that we rectify the personal data stored about you if these are inaccurate or incorrect.

Right to erasure: You are entitled, under the conditions of Art. 17 DSGVO, to request from us that we erase personal data concerning you without undue delay. Among other things, the right to erasure does not exist where the processing of the personal data is necessary for (i) exercising the right of freedom of expression and information, (ii) compliance with a legal obligation to which we are subject (e.g. statutory retention obligations) or (iii) the establishment, exercise or defence of legal claims.

Right to restriction of processing: You are entitled, under the conditions of Art. 18 DSGVO, to request from us that we restrict the processing of your personal data.

Right to data portability: You are entitled, under the conditions of Art. 20 DSGVO, to request from us that we hand over to you the personal data concerning you which you have provided to us, in a structured, commonly used and machine-readable format.

Right of withdrawal: You have the right to withdraw the consent you have given to the processing of personal data at any time with effect for the future.

Right to object: You are entitled, under the conditions of Art. 21 DSGVO, to object to the processing of your personal data, so that we must cease the processing of your personal data. The right to object exists only within the limits provided for in Art. 21 DSGVO. In addition, our interests may preclude a cessation of the processing, so that we are entitled to process your personal data despite your objection.

Right to lodge a complaint with a supervisory authority: You are entitled, under the conditions of Art. 77 DSGVO, to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, your place of work or the place of the alleged infringement, if you are of the opinion that the processing of the personal data concerning you infringes the DSGVO. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Your requests regarding the exercise of your rights should, where possible, be addressed in writing to the address stated above or directly to us.

IX. Scope of your obligations to provide data

As a matter of principle you are not obliged to provide us with your personal data. If you do not do so, however, we will not be able to make our website available to you, will not be able to answer your enquiries to us and will not be able to enter into a contract with you.

X. Automated decision-making / profiling

We do not use automated decision-making or profiling (an automated analysis of your personal circumstances).

Information about your right to object, Art. 21 DSGVO

You have the right to object at any time to the processing of your data carried out on the basis of Art. 6 Abs. 1 f DSGVO (data processing on the basis of a balancing of interests) or Art. 6 Abs. 1 e DSGVO (data processing in the public interest), where there are grounds relating to your particular situation. This also applies to profiling based on this provision within the meaning of Art. 4 Nr. 4 DSGVO.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

XI. Amendments

We reserve the right to amend this privacy policy at any time. Any amendments will be announced by publishing the amended privacy policy on our website. Unless otherwise specified, such amendments take effect immediately. Please therefore review this privacy policy regularly in order to view the most current version.
